About Gyftly and these Terms

Gyftly is operated by Limelight Software SRL. Contact us at [email protected].

These Terms apply to the Gyftly website and our mobile apps, including Android and iOS where available. They cover the same account and collaboration features across these platforms, subject to device and platform support.

By creating an account or using Gyftly's account and collaboration features, you agree to these Terms. If you do not agree, do not create an account or use those features. Our Privacy Policy explains how we handle information; agreement to these Terms does not supply consent for every use of personal information or nonessential cookies.

Eligibility and your account

You must be at least 18 years old to create or use a Gyftly account and have the legal capacity to enter into these Terms. Adults may create lists for children.

After signing in, users whose confirmations have not been recorded must complete a confirmation step agreeing to the Privacy Policy and Terms and declaring that they meet the age requirement before continuing to account features. This also applies to existing accounts without those confirmations. The declaration is not independent age verification. The separate Google Analytics option is optional and can be changed later in Settings; it is not a condition of using the account features.

You can register using email and a password or sign in through the available Google, Facebook, or Apple methods. Availability depends on the platform, device, and provider. Apple sign-in requires sharing your email address; Apple's Hide My Email private relay addresses are not accepted. Choose Share My Email with Apple or use another sign-in method. Complete any required email confirmation and provide accurate information that you are entitled to use. Do not impersonate someone else or use another person's account without authorization.

Social sign-in can access an existing Gyftly account when the provider supplies a matching email address. Choosing another provider does not necessarily create a separate account, and signing in can update provider-supplied profile information, such as your name or image. Different accepted email addresses can result in separate accounts. Gyftly does not automatically merge accounts based on their belonging to the same person.

Keep your password and access to your sign-in provider secure, and contact us if you suspect unauthorized access. You are responsible for your own use and for activity you authorize. You are not automatically responsible for unauthorized activity merely because it occurred through your account.

What the service does

Gyftly helps people create and share gift lists, save product information, record contributions, agree who will handle a gift, communicate through list chat, and track reported transfers and balances. It also provides product suggestions, product-page imports, and service notifications where supported.

These tools help users coordinate their own arrangements. Gyftly does not purchase or deliver gifts, hold contribution funds, or execute payments between users.

Permission to use the service and intellectual property

You may use Gyftly's provided features, including creating and sharing lists, subject to these Terms and applicable law. Rights in the service's software, design, names, logos, and branding remain with their respective owners. Permission to use the service does not transfer those rights or authorize you to present another service as Gyftly or imply our endorsement without permission.

Third-party software and materials remain subject to their applicable licences and rights. Nothing in these Terms overrides permissions granted by those licences or exceptions and permissions provided by law. Rights in your submissions and merchant content are addressed below.

Lists, links, and collaboration

A list owner can choose whether guests may view the list and whether other users may add gifts. Lists are accessed through their links. If anonymous viewing is enabled, someone with the link can view the list without signing in. Otherwise, sign-in is required, although the login notice can still show the list title. Requiring sign-in does not create an individually approved invitation list. Links can be forwarded.

People viewing a list can see its displayed gifts, event information, participant identities, handling assignments, contributor activity, and aggregate progress. The list page shows individual contribution amounts to the owner; balances and notifications can also disclose relevant amounts and payment-status information. Signed-in users with the list link can access the list chat.

Your profile link allows signed-in users to view your name, profile image, and last-contribution activity. If you have blocked someone, their last-contribution activity is hidden when you view their profile. Your email and country on the profile page are visible only to you when signed in to your own account. Details you share yourself in chat, list content, or external messages remain subject to that sharing. Consider this visibility before entering information or sharing links. External sharing services and recipients may receive messages, links, and page previews.

The owner manages list settings and has editing and removal permissions provided by the service. Other users' editing, gift-addition, contribution, and handling permissions depend on the list settings, ownership of the entry, and the list's state. A list can close automatically according to its configured date and timezone, restricting changes to gifts, contributions, and handling. Closing a list does not delete its records or settle outstanding contributions.

Blocking and reporting

Signed-in users can use Remove & Report on another user's gift if its creator is not the list owner, or Block & Report on another user's profile. Give a reason and any relevant details. A successful action sends evidence to support; reports can include relevant account, list, gift, chat, visit, participation and contribution records. Ordinary email failures leave the requested action unapplied. Support email acceptance is not a guarantee of inbox delivery; contact support with the report reference if completion is uncertain.

A reported gift is hidden for everyone. Blocking applies to the reporting user's lists: the blocked account loses access to existing and future lists, its gifts and activity there are hidden, and all visitors must sign in. Affected unsent and unreceived pledges are cancelled. Records with a sent or received confirmation are removed from normal activity and balances and kept privately for support with their original recipient. Gift handling is released. This does not reverse payments or settle obligations outside Gyftly. Multiple users may independently report the same account. Contact support for unblocking or restoration; reporting alone does not suspend an account across the service.

Contributions, transfers, and purchases

Entering a contribution records the amount you have agreed to contribute. Taking responsibility for a gift records your agreement with the other participants to handle it. Make these arrangements carefully, keep your entries accurate, and communicate changes to the people affected.

Payments and purchases take place outside Gyftly. You and the other participants decide how to transfer money, buy a gift, obtain receipts, and resolve differences. Check the recipient and payment destination independently before sending money. Arrange payment destinations directly with the other participants outside Gyftly.

The actions labelled as transferred, received, or settled record users' reports. A reminder, balance, notification, or settlement status is not independent proof that money was sent or received. Gyftly does not verify bank movements, guarantee a participant's contribution, provide escrow, or recover payments on your behalf. Resolve disagreements with the participants and the relevant merchant or payment provider; you can contact us about misuse of Gyftly.

Retailers and other third parties set their own prices, availability, payment conditions, shipping, returns, and warranties. Purchases are governed by your agreement with the relevant seller. Gyftly does not participate in affiliate programs or earn affiliate commissions from product links.

Deleting or changing a contribution record does not, by itself, cancel any separate agreement or obligation between participants. Similarly, deletion of an account or list does not reverse a payment or purchase made elsewhere.

Contribution history is editable coordination information. Gifts and their associated contribution records can be removed, and changing a gift's currency clears its existing contributions. Keep independent records of transfers, receipts, and agreements; do not use Gyftly as your sole record of external payments or obligations.

Imported products and suggestions

Product details may be entered manually or extracted from a linked page. In the Android app, importing can load the selected page on your device and send its rendered HTML to Gyftly for extraction. Gyftly can also fetch pages through its server-side extractor. Equivalent app features, where available, are subject to platform support. The Privacy Policy explains the information handled during these operations.

Device-based gift importing is optional in the Android and iOS apps where supported. In Settings → Other, “Import gift data using the device” is enabled by default when no preference has been saved. To change it, use the switch and select “Save settings”; the saved choice applies when the gift-list page is next loaded. When disabled, imports use the server-side extractor directly instead of loading the merchant page on your device and uploading captured HTML through this import flow. Imported titles, prices, currencies, or images may be incomplete or unavailable for some stores. This setting does not change imports in a regular web browser.

Import only pages and information you are entitled to use. Prefer public product pages and avoid URLs containing private account, order, or access information. Do not use imports to access restricted systems, bypass access controls, or extract another person's private information.

Review and correct imported titles, prices, currencies, images, and links before saving. Extraction can fail or return incomplete or outdated information. Prices, stock, delivery, and merchant conditions can change after an item is saved. Product suggestions are drawn from a catalogue using recipient information such as age and gender; they are not a guarantee of suitability or safety. Check the merchant's current information and the intended recipient's needs before purchasing.

Your content and other people's information

You retain the rights you hold in content you submit, such as list text, messages, and images. You grant Limelight Software SRL a non-exclusive permission to host, store, process, reproduce, format, and display that content as necessary to operate Gyftly and deliver the sharing and notification features you use. This permission includes processing by service providers for those purposes and does not give us ownership of your content or an unrestricted right to use it for unrelated advertising.

You must have the rights or other lawful authorization needed to submit and share content. Product descriptions and images may belong to merchants or other rights holders; importing them does not transfer their ownership to you or us.

When creating a list about someone else, use only personal information you are entitled to share, respect their privacy, and inform them or their parent or guardian where appropriate. Adults organizing gifts for children should limit the information they disclose. Do not put unnecessary sensitive information, credentials, or private financial information into lists or chat.

Shared content can be seen, copied, or retained by others as described in the Privacy Policy. Removing it from Gyftly cannot retrieve copies already made by other people or remove information from an independent merchant, messaging app, or payment service.

Acceptable use and reporting problems

You must not use Gyftly to:

Report misuse, an unlawful link or message, or a rights concern to [email protected]. Include the relevant page or list link, a description of the issue, and enough information for us to assess it. Avoid sending unnecessary personal information. Reports are handled by us; the service does not promise that every entry is reviewed before it appears.

Where reasonably necessary to address unlawful content, a serious breach of these Terms, or a security threat, we may remove content or restrict access. Any action must remain subject to applicable law and your rights. We will consider the circumstances and, where appropriate and lawful, explain the action and allow you to contact us about it.

Notifications

Gyftly can send email and app notifications about your account, gifts, contributions, chat, reminders, and reported transfers. You can manage optional notification types, reminder timing, and list mutes through the controls provided. Some account emails are required, and muting a list does not silence every account-, mention-, or contribution-related message.

App push display also depends on operating-system permissions and device settings. Delivery may be delayed, grouped, blocked, or unsuccessful. Do not rely on a notification as the only way to track an event, verify a transfer, or meet an obligation. Notification and email previews can contain information about your lists, activity, and contributions.

Removing information and ending use

You can stop using Gyftly at any time. Signing out or uninstalling an app does not delete your account or server-side records. Removing a list from your recent lists removes that shortcut rather than deleting the shared list.

List owners can delete lists where the service permits it. Ordinary list deletion is blocked while contributions remain unsettled, and gift or contribution changes are subject to the permissions and state of the list. These product restrictions do not remove your legal right to request erasure of personal information.

The restriction on deleting an entire list does not prevent every change to an individual gift. Where their permissions and the list's state allow it, the owner or the user who added a gift can delete it, which also removes its contribution records even if some remain unsettled. Changing a gift's currency also clears its existing contribution records. Check the effect on other participants and keep any independent records you need before making these changes.

To request deletion of your account and associated data, contact [email protected] with the subject "Delete my Gyftly account" and identify your account email address. You can request deletion without signing in or reinstalling the app, including when contributions remain unsettled. Do not send your password. We handle these requests administratively and may need to verify your identity. Deactivation does not replace deletion.

The account-deletion process removes owned lists, gifts you added to other people's lists, associated contributions, your messages, and other account-associated records and files, and releases handling assignments. It can therefore affect other participants and their coordination records. The Privacy Policy explains response periods, handling of service-provider data, and limited retention for legitimate purposes.

After access ends or records are removed, applicable legal rights, obligations between participants, and provisions needed to handle existing claims still apply. The content permission above continues only to the extent necessary for content still lawfully held or displayed for the purposes described there.

Availability and responsibility

We aim to provide a useful service, but cannot promise uninterrupted access, delivery of every notification, successful extraction from every merchant, or that information supplied by another person is accurate. Maintenance, technical failures, provider changes, and device restrictions can affect availability. Features may be changed or discontinued for reasonable operational, security, or legal reasons, subject to any notice, termination, or other rights required by law.

You remain responsible for checking product and payment details and for decisions and arrangements you make with other users or third parties. Their independent conduct does not become Gyftly's conduct merely because you used the service to coordinate with them. This does not exclude responsibility that the law places on us for our own service or actions.

Nothing in these Terms excludes or limits liability for fraud, intentional wrongdoing, death or personal injury where exclusion is prohibited, or any other liability that cannot lawfully be excluded or limited. Your mandatory consumer and data-protection rights remain unaffected. We do not require you to waive those rights or indemnify us against all claims involving another website or user.

Changes to these Terms

We publish revised Terms on this page with an updated date. Changes apply prospectively and remain subject to applicable requirements for notice or agreement; publication alone does not override those requirements. A change does not retrospectively alter payments, purchases, or separate agreements between users. If you do not agree to a change, you can stop using the affected features and contact us about your account.

Governing law and contact

These Terms are governed by Romanian law. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law that would otherwise apply to you. You retain any right to bring a claim before a competent court or authority available under applicable law; these Terms do not impose exclusive jurisdiction in Romania or mandatory arbitration.

For questions about these Terms, service problems, or reports, email [email protected] or write us at Sos. Mihai Bravu 204, bl. 105, 030316 Bucharest, Romania attn Limelight Software SRL.
